CAP Conformité: AMELEGAL launches its online self-assessment for compliance with Law No. 2019-014
Personal data protection is no longer a distant prospect in Togo: it is an obligation subject to inspection. Since the Personal Data Protection Authority (IPDCP) became operational and the deadline set by article 95 of Law No. 2019-014 expired, one question keeps coming up in practice: where do we start?

An assessment calibrated to Togolese law, not to the GDPR
Most of the resources in circulation are designed for the European regulation. Yet Togolese law has a logic of its own: a regime of prior formalities (exemption, notification, authorisation, opinion) and institutions of its own, such as the data protection officer, whose appointment exempts you from the formalities and carries the obligation to maintain a record of processing activities (article 76-5°). CAP Conformité therefore follows the structure of Law No. 2019-014 itself: each question refers back to the article from which it derives.
A score that reflects real legal exposure
Not all obligations carry the same weight. Each item is given a coefficient according to the severity of the penalty attached to the breach, and each area a weighting according to its exposure. A floor rule reinforces this logic: as soon as an answer reveals a criminally sanctioned breach (processing without formalities, sensitive data without a lawful basis, prospecting without consent, transfer outside Togo without informing the IPDCP), the score is capped and a separate alert is displayed.
A practical report, not merely a score
At the end of the assessment, the organisation receives a full report in PDF format: its score, a detailed profile by area, and a ranked action plan. Each action is graded by priority and refers both to the article establishing the obligation and to the article imposing the penalty, together with the sentence incurred and the range of fines provided for by the law. The report can be received directly by email.
CAP Conformité is a self-declaration assessment tool. It constitutes neither an audit, nor legal advice, nor a certificate of compliance enforceable against the supervisory authority: it measures the declared completeness of a framework and serves as a reliable starting point.
